there is potential legal liability for the site if they continue to host links. The links were also getting obnoxious with people asking for passwords.

Bad jokes aside, while I didn’t like Dave’s moralistic tone (if the Blazers really cared about their fans to the level they are morally obligated to some deference, they wouldn’t have signed that deal in the first place) this is a smart move for BE. I’m a regulatory attorney, not an IP/copyright guy, so take this with a grain of salt, but BE could be in for a heck of a headache if they are facilitating the unauthorized distribution of copyrighted works. At the very least, there’s a colorable claim there – which means lawsuit, discovery, legal fees, etc. And heaven knows the NBA/Comcast have the deep pockets to pursue this should they choose to do so. A rough analogy would be a discussion board where people were posting links to pirate music/full length films. YouTube had some issues with this, so this is the right move.
Dave, you’re the man, a great writer, and I respect you but the moral high ground is certainly not the property of Comcast/the Blazers on this one. I don’t choose to use Comcast for my own reasons, but telling Blazer fans on the coast, eastern and southern Oregon, some parts of Washington county who don’t have that option that they are honor bound to take their medicine and count on the benevolence of Larry Miller doesn’t fly for me. Screed over. Let’s go Blazers (and might I add, Wheels is in good form tonight)!

That’s why I’m pretty convinced that in this battle of faceless corporate entities, Comcast is the villain rather than DirecTV/Dish. Comcast makes CSN Bay Area and CSN CA available on DirecTV. They are part of a sports pack that costs extra each month (also includes ESPNU and NBA TV). I would happily pay a premium for CSN NW to be included and watch the Blazers. But apparently (take this with a grain of salt, as this is DirecTV’s answer) Comcast wants CSN NW included at a higher than standard premium rate. My only guess is that Comcast wants to price this so high that it makes DirecTV unpalatable for current subscribers. That’s their right as a player in a competitive marketplace, but it still stinks and made Dave’s “do the right thing” argument a bit off in my eyes.
