Original Sports Illustrated article.

You all know what happened.  First linked here by blazerhopeful then re-reported by broyposse and generally flipped out on here, the blazers have thrown down the gauntlet when it comes to signing darius miles.  Since the first thread is now well over 300 comments, lagging, and also lacks a poll, here is part duece.

Now that we've fired off oppinions all willy-nilly, maybe it's time to debate this in a more structured manner?

I do think this was a good move.

Aggressive, auspicious, and perhaps a little whiny yes, but GM’s were openly saying they would consider signing him to a 10 day contract for the specific purpose of hurting our cap, so the office probably felt they had to do something.

and immediately go rent the film. Watch it and thank me later. Big Lebowski is one of those rare perfect films. Like “Princess Bride” and “Heat” it is a flawless film within it’s genre. Although Big Lebowski is almost it’s own unique entity. God I love that movie.

Issues like medical retirement should be pretty easy negotiation

between the NBA and the Players Association as it is clearly in both parties interest to avoid situations where potential legal action is talked about.

Issues like how much of basketball revenue (and how such revenue is calculated) is where the difficulty in the collective bargaining process comes about.

at one of my property lectures an intellectual property attorney introduced me to the concept of worst-case-scenario time travel. Imagine that someone has infringed upon your clients patent and you’ve not taken measures to protect him and you are in front of a jury. If you could go back in time, what would you have done differently so that you could tell it to the jury? Figure out what that is and do it now, beforehand.

The Blazers are setting up a "bad faith" argument. They are laying the foundation for a formal complaint. If this deters suitors for Miles, all the better. Also, since Miles was ruled unfit to play by an impartial doctor and he is still getting his money, it would be hard for him to push a case against PDX because the detriment to PDX would be unconscionable. He gets his 9mil, and Blazers are both penalized and unable to use his services when neither had reached any sort of buy-out agreement.

Darius will probably play, and PDX will probably appeal, and may use media articles to demonstrate that GM’s knew of the detriment to PDX and played Darius Miles in bad faith to hurt PDX’s capspace. That whole fiduciary duty thing holds quite a bit of weight, holds you to a higher standard of ethics. If it even smells like bad faith in a fiduciary relationship, it probably won’t go well for the "bad-faith-er" (not a legal term, but it’s more simple than "tortfeasor")

This will probably not be over for a while…

It's a double edged sword

Blazers are positioning to sue another team, but doing it this way may give Miles/the NBA PA grounds for a claim against the Blazers. This is why the letter strikes me as maybe not the best way to do things, it opens the Blazers to a fair degree of risk

He would still be sitting on his duff if he was on Portland’s roster. However, now that he can pad a few more hundred thousand dollars he is magically healed and able to play. at one of my property lectures an intellectual property attorney introduced me to the concept of worst-case-scenario time travel. Imagine that someone has infringed upon your clients patent and you’ve not taken measures to protect him and you are in front of a jury. If you could go back in time, what would you have done differently so that you could tell it to the jury? Figure out what that is and do it now, beforehand.

The Blazers are setting up a "bad faith" argument. They are laying the foundation for a formal complaint. If this deters suitors for Miles, all the better. Also, since Miles was ruled unfit to play by an impartial doctor and he is still getting his money, it would be hard for him to push a case against PDX because the detriment to PDX would be unconscionable. He gets his 9mil, and Blazers are both penalized and unable to use his services when neither had reached any sort of buy-out agreement.

Darius will probably play, and PDX will probably appeal, and may use media articles to demonstrate that GM’s knew of the detriment to PDX and played Darius Miles in bad faith to hurt PDX’s capspace. That whole fiduciary duty thing holds quite a bit of weight, holds you to a higher standard of ethics. If it even smells like bad faith in a fiduciary relationship, it probably won’t go well for the "bad-faith-er" (not a legal term, but it’s more simple than "tortfeasor")

This will probably not be over for a while…

Timmay asked me to re-post this, so I shall.

NOT THAT WE GOT ACCESS TO ALL OF THE DETAILS… But my fancy pants Ivy league lawyer fiancee says the Blazers are likely okay in all scenarios, based on what we know as fact and what we can safely assume about the expertise of PA’s legal army.

FIRST: the medical retirement rules were not made with this situation in mind. It was written to prevent teams from getting out of big bad deals and then re-signing the player, not for guys deemed by independent docs to be too injured to play anymore and then to make a come back. The Blazers would appeal the money going back on the cap and likely win.

SECOND: Paul Allen is lawyered up out the wazoo, as would be Larry "I ran Nike and know what I’m doing" Miller. This has been risk assessed and gone over a billion times by other fancy pants Ivy League lawyers. It would be much easier to prove a franchise hurt another franchise’ business by signing Miles with no intention to really play him in this VERY UNIQUE situation than it is the Blazers preventing Darius from getting another job, after being cut a few times by different teams after being medically retired and STILL not in good enough shape after over 2 years of rehab.

Darius hasn’t been able to keep a roster spot in the best situation in the league for him, the Grizzlies. They had the space, were bad, and took a chance on him. He wasn’t worth the marginal salary it would take to keep him (a vet minimum salary is also half paid for by the NBA, making it even cheaper). Darius has had plenty of chances to find a job and has been unsuccessful. The Blazers letter comes out after this, so it didn’t prevent him from getting work.

Darius could sue, but he won’t. He will lose, and doesn’t have nearly the resources PA does.

Ethical or not, it doesn’t matter. This frightens off anyone who might have the bright idea of signing Miles to muck with the Blazers, or to make a few extra hundred thousand from the luxury tax payment they’d get from Portland being in luxury tax land. Do you, struggling owner of the Grizzlies, want to battle with PA’s billions? Heck nah, phoo!

This is a strong arm tactic that makes sense from the Blazers perspective, and would be MUCH more unethical if it was sent out before Darius had plenty of chances to find a job.

Darius’ injury has robbed him of his athleticism, which was the only thing he had before. I rooted for Darius to make a team personally, as I hate promising careers being ended because of injury. He is obviously not ever going to be the same again, which should be expected after the YEARS of doctor examinations and tests by independent docs and the insurance companies.

The Blazers were obviously at least a little worried that another team would try to mess with us, so they made clear they wouldn’t sit back and let it happen easily. Darius doesn’t have the resources even if he had a case, and he doesn’t likely have a case as he hasn’t been able to get a job on his own before this.

I’m sure this won’t help, but the Blazers only don’t have a case if Miles actually sticks somewhere and plays. If anyone wanted him and he was capable of playing, HE WOULD BE PLAYING.

This is a wierd situation with no precedent. I don’t blame the Blazers for being aggressive, and you can probably assume our aggressiveness will pay off for us. The aggressive team gets the calls, after all.

I am only engaged to a smarty pants lawyer, and my pa is a lawyer, and one of my sisters. I am not an expert. But this isn’t as bad as all that. Like always with the Miles situation, we just gotta wait and see.

Rest assured the Blazers have, uh, pretty good legal advice. Billions of dollars still buys good advice these days.

my point is that if I'm running another NBA team...

… and I have a roster spot that I could fill with, say, Luke Jackson or Darius Miles (both of whom can fill 2 min of garbage time), I’m filling it with Darius Miles because it carries the ancillary benefit of hurting the Blazers.

So that the GM takes Luke Jackson, to have a player, and not just to hurt the Blazers.

Both are unethical moves, if you wanna see it like that. The Blazers act unethically to prevent another team acting unethically. Doing a wrong to prevent a wrong makes a right ;-)

but how do the Blazers have a case here?

If Miles is healthy enough to play in garbage time, he has by definition not suffered a career ending injury, and therefore the Blazers shouldn’t receive benefits as if he did.

the MD from the Players Assoc. did. They were following his/her advice, that playing on the knee could cause potential serious injury to Darius and he is therefor unfit to play. Why would you keep him?

The docs argument always was

That continued play could result in needing a knee replaced.

It doesn’t mean he can’t run and “play” on his knee as is. It is Miles’ risk to take, and another team’s risk to take. Obviously, no one has wanted to really take the risk beyond taking a flyer to see where Miles is at in his recovery, or he would be on a team.

If they are only signing Miles to screw the Blazers, I won’t cry myself to sleep at night for the Blazers to do their best to prevent that. You’re actually bothered by the Blazers writing a letter like this to prevent another team from doing something MORE unethical?

Miles might just need more time to get in shape and rehab. It’s only been two years and he had an awful injury that kept re-injuring itself. If he was ok enough now, he would be on a team, as simple as ’dat.

He might be ok again in the future, who knows.

It would be the first time it ever happened, as you know. If he isn’t good enough to play now and a team only signs him to screw the Blazers, that is more unethical than telling a team “hey don’t do that or we will sue”.

He's tall with long arms and used to be an athletic marvel

If he maintained any of that he’d still be reasonably athletic for a normal person.

If he was still NBA athletic, he’d be on a NBA team. That was the argument before all of this, and it’s the same thing. Darius was a very talented player before, but one who relied on his athleticism. If he doesn’t have the same athleticism, he isn’t worth much as a player on the court.

He’s not an invalid or a cripple. The docs just think playing on his knee is risky.

And again, if he was athletic enough to be useful, he’d be on a NBA team.

But... will he?

If he couldn’t stay on the Grizzlies, I don’t expect he’ll make a team.

His contract would be half paid by the NBA and if he was ANYTHING close to what he was, he would be signed.

He is STILL out of shape after 2 years of rehab. He doesn’t move well. Again, it’s not like he’s a cripple so just being able to walk without a limp or something doesn’t mean he is okay.

As always I will wait and see, and I hope he does come back because I was always a fan of what Miles could potentially do. I do not ever root against him or any other injured player.

Honestly, I don't want to see him come back

But it’s not because I have anything against him. I just don’t want to see him get permanently injured. I’d rather he go enjoy his life, rather than try to prove he can return while doing major damage to an important body part.

I’m dreading the video on ESPN showing him crumpled on the court, in pain.

If he could continue without doing damage, then hey, play away. Otherwise, I understand why the NBA (and the players union) cleared his early retirement.

One would assume that he would have his own best interests at heart though

The doctor who determined him too damaged to play said that if he did play he would more than likely need to have his knee replaced. Seems to me that, keeping his health would be more important than proving someone wrong when it wasn’t the Blazers making the final determination to begin with.

While Darius’ knee hasn’t had as much work done on it as Reggie’s, at some point I think you need to say “As much as I love playing in the NBA, I love walking without pain more” Clearly Reggie wishes he could go back and make some better choices in regards to his knee health.

He’s like a combination of a healthy Penny Hardaway, an in-prime John Stockton, Steve Nash from two years ago and Gary Payton.

I think the 4.5 million in luxury tax makes a difference to PA

I’ve looked through the free agent class this summer and I don’t really know who we would spend the money on. Re-signing who we have seems like the only thing we should be concerned with.

Also true, PA is a billionaire but in the past he was reluctant to spend money for nothing

As for the free agent class, yes there is little amazing in there (unless Kobe declares), but as I tried to point out in several posts we could be left with just 4 to 9 million (if they let Ike and Channing walk) and you don’t get much for that. The Blazers might even push deliberately over the cap to get an MLE.

the blazers edge brain trust is the best. ive read the comments in all the national and local stories, and even thow it took over 800 comments to gain some true perspective, i trust that anyone that has read the entirety of these threads could well argue for the blazers with anybody. some of the comments outside of the bedge seam so shortsighted and lacking after having read wut weve created. there have been a ton of comentors that have positivly contibuted to my perspective on this situation. thanks all, its been fun.

Much like ON the court, protecting your interests is more important than playing nice

The rest of the league is going to hate a small-market team standing up for itself. And I’m sure a lot of sensitive Portland fans will tear their hair out worrying about what others think of us.

Me? I think it’s great. Notify everyone that if they sign Miles, they will be under a microscope.

Miles gets paid one way or the other. Let’s not pretend Miles really cares about his NBA legacy.

The best part of all of this

is it forces the league to clarify this issue. Common sense would say no team should have to worry about getting screwed over by a vindictive player or team, especially when all the rules have been followed. I expect the league to clarify, absolve Portland of the cap hit, and Darius can go out and prove that he really wants to play, not just bend us over.

But David Aldridge has a small article on nba.com homepage right now that has the league’s executive director, Mr. Hunter, basically calling KP and LM out and saying “Given my own druthers, I’d have a complaint filed in U.S. District Court this afternoon,” when asked about his reactions to the team’s letter.

That’s not great news, but I’m all for this letter based on the syntax (that’s the big word for the day) of the letter alone. I don’t think of this as whining so much as showing some backbone and grit on the business management side of the organization. Go Blazers.

and even though it seems we might be standing on solid legal ground, we are DEFINITELY not winning the PR war. Headlines like “Blazers Try to Blackball Miles” do not help our cause. We will definitely come out of this looking like bad guys. Whether the PR hit is worth it for the shot at some extra cap space, I guess we’ll have to see about that. Miles and his agent have positioned themselves as victims and KP has already developed a reputation for being aggressive and threatening to the NBA front office status quo. I think we’re getting into Mark Cuban territory with this one — that is, alienating ourselves from the “old boys’ network” of NBA front office and media types and becoming a polarizing figure in the league.

Blazers Broadcasters Mike Barrett and Mike Rice re-enacted NBA referee Scott Foster's controversial goaltending call on Portland Trail Blazers forward LaMarcus Aldridge, who was defending Oklahoma City Thunder All-Star forward Kevin Durant, during this week's edition of Blazers Courtside. Remarkably, no one was injured during the taping of this segment.
